The justification and advantages of designations of origin in relation to the trademark for agricultural-food products in the European Union and the Republic of Moldova is dictated by the conditions of product market diversification through their quality and origin. Access to new markets is favored by completing the negotiations on the Free Trade Agreement, which is an integral part of the Association Agreement between the Republic of Moldova and the European Union, as well as by signing the Agreement between the Republic of Moldova and the European Union regarding the geographical indications of products agricultural and food, ratified by Law of the Republic of Moldova no. 317 of December 27, 2012. According to the last mentioned agreement, the Republic of Moldova is obliged to ensure compliance with geographical indications on the territory of the European Union, benefiting in return from the protection of domestic products with designations of origin. The relatively small number of products with designations of origin in the Republic of Moldova diminishes the importance of their protection on EU territory and implies obligations regarding the protection of products with designations of origin from the EU. Also, the tradition of the EU states in the field of agricultural-food products is focused on the origin and qualities related to the territory. The study carried out is based on a series of methods applied and used in order to identify and describe all the advantages of the designations of origin in relation to the trademark. The conclusions reached show that the current legal regime at the international, European and national level allows the marketing of quality products under brands or names of origin. In the conditions of the development of market relations, the flexibility of agricultural producers is required, focused both on objective factors (relatively small production quantities, product diversity, the regulatory framework, international and European requirements), and on subjective factors (the requirements of domestic consumers, Europeans etc.). |
