In the practice of criminal investigation there is a widespread use of experimental methods of working with evidence in criminal prosecution. The experimental method of investigation has found its final expression in the evidentiary procedure under the name of experiment in the criminal prosecution procedure, where the experience is found as the basic content of the work of the criminal prosecution bodies. At present, the role and place of experiment in the system of evidentiary procedures can be correctly perceived and determined only in cases when we demonstrate certain correct representations in relation to it, about the purposes pursued by it within the framework of criminal procedural and forensic activity. The experimental research method can serve as a forensic research method if it is used properly and within the limits of the criminal procedural and tactical-criminal framework. Experimentation in criminal proceedings is a method developed and perfected by the science of criminal procedural law and forensic science, fields of legal science that focus on the development and application of tactical procedures and procedural-criminal rules for the conduct of such criminal prosecution. At present, however, the issue of the concept, purpose and variety of experiment in criminal proceedings is controversial in the literature, which underlines the topicality of the scientific research carried out. |
