Prezentul demers științific propune câteva scurte reflecții privind drepturile și obligațiile ce incumbă statelor membre ale Uniunii Europene, stipulate cu claritate, pentru prima oară prin Tratatul de la Lisabona. Pe cale de consecință, articolele 4 și 5 din Tratatul de la Lisabona vin să aducă în atenția cetățeanului european un catalog al competențelor Uniunii, al obligațiilor politice pe care aceasta din urmă le are față de statele membre. Pe de altă parte, articolul analizează și o serie de aspecte versatile ce privesc statutul de țară membră UE, poziție ce nu implică doar dreptul statului respectiv de a participa la procesul decizional, ci și drepturi care rezultă din calitatea de cetățean european. Prin urmare, prezentul studiu debutează cu o prezentare sintetică a condițiilor de aderare a statelor la UE, pentru ca apoi să devoaleze procesele de aderare ale Marii Britanii și României, ca reprezentante a primului val de extindere a UE – Marea Britanie, respectiv a penultimului și a celui mai mare din istoria UE – România. În final, analiza se centrează pe invocarea de către un stat membru – Marea Britanie a articolului 50 din Tratatul de la Lisabona, ce prevede posibilitatea părăsirii Uniunii Europene de către un stat membru, articol inițial văzut ca fiind doar ceva formal, dar care avea să declanșeze în evoluția Uniunii Europene un moment de cotitură, soldat după lungi dezbateri și tratative, cu părăsirea UE de către Regatul Unit în 31 ianuarie 2020.

This scientific approach proposes a few brief reflections of the rights and obligations of the member states of the European Union, clearly stipulated, for the first time by the Lisbon Treaty. As a result, articles 4 and 5 of the Lisbon Treaty come to the attention of the European citizen with a catalog of the Union’s competences, the political obligations that the Union has towards the member states. On the other hand, the article also analyzes a number of versatile aspects regarding the status of the EU member country, a position that involves not only the right of the respective state to participate in the decision – making process, but also rights that result from being a European citizen. Therefore, the present study begins with a synthetic presentation of the conditions of accession of the states to the EU, in order to then devolve the accession processes of Great Britain and Romania, as representatives of the first wave of EU enlargement – Great Britain, respectively the penultimate wave and the largest in the history of the EU – Romania. Finally, the analysis focuses on the invocation by a member state – Great Britain of article 50 of the Treaty of Lisbon, which provides the possibility of a member state of leaving the European Union, an article initially seen as merely formal, but which would have to be a turning point in the evolution of the European Union, after long debates and negotiations, with the Great Britain leaving the EU – January 31, 2020.
