Any company is a legal person, commercial organization, the share capital of which consists of the shares of its founders (of is members). The commercial company can only be formed under that form, which is expressly stipulated by the legislation of the Republic of Moldova. The organizational-legal form of a commercial company, can be changed in the result of the organization by transforming it. Reorganization through transformation is the technical-juridical process, as a result of which only the passing of the trading company from one organizational form to another, also preserving the component of the patrimony, the rights and the obligations towards and debtors, and the lucrative benefits prongs. |
