Rezumat

The European Convention on Human Rights is an international treaty that not only sets out a list of rights and freedoms, but also establishes the means of achieving fair satisfaction in the event of their breach. This mechanism is implemented primarily through the European Court, which has the fundamental task to interpret and apply the rules of the Convention. In order for the applicant to benefit from the services of the Court, it must be competent to resolve the specific case, so it has the personal and territorial competence to rule on an alleged infringement. This fact necessarily implies the existence of the protection obligation. The European Convention on Human Rights has transformed the internal landscape of policymaking of European states, becoming an effective measure of influence of national security strategies and policies. The Republic of Moldova is firmly on the path of promoting and protecting human rights, including through the ongoing process of connecting national legislation to international standards. However, it is not sufficient to proclaim the attachment to human values, to declare them as major goals; we must promote them and respect them by establishing effective mechanisms of enforcement. The applicative value of the research carried out can be evidenced by the doctrinal and theoretical foundation, characterized by the legal nature of the ECHR. The research carried out in this field can contribute to a deeper study, analysis and definition of the importance of the ECHR.
