| Rezumat | ||||||
The article contains considerations of political-penal nature referring to the abolition of the institution of offence recurrence. As compensation to this exclusion, the authors suggest the legislator to extend the effect of the “contest of offences” concept on the committing of two or more identical offences by the same offender. This will contribute to a better differentiation of the penal responsibility, to a more equitable establishment of the punishment, to a more consistent promotion of the goals and principles of the penal law and to the raising of the penal justice standards. |
