Rezumat

During the academic year 2020-2021, the Extraordinary National Commission for Public Health of the Republic of Moldova and the Extraordinary National Commission for Public Health of Chisinau adopted decisions ceasing the educational process with physical presence in classrooms, which was placed in the online environment. n addition to the fact that these norms are clearly unconstitutional, and the courts empowered with the right to control normative acts that are not subject to constitutional review have rejected appeals against the norms in question, Moldovan students were the subject of an experiment discriminatory in the conditions in which the state has proved incapable of ensuring efficient and coherent measures to provide free students with electronic devices connected to the Internet and to guarantee the development of a quality educational process. The decisions of these Commissions to restrict the right to education collide with Articles 54 and 60 of the Constitution, which offer only the Parliament of the Republic of Moldova prerogatives to restrict rights and freedoms in concrete situations. Thus, having a functioning Parliament, only this institution was entitled to decide to move the educational process to the online environment and only in the presence of documents, scientific studies and statistics to support the proportionality and the need to cease the educational process in classrooms.
