The rules of establishing the place of a transnational crime stipulated in the art.12 §(2) of the Criminal Code of Moldova have been adopted in the light of Republic of Moldova respecting its obligations of cooperation with other states in combating transnational criminality. These rules allow making the conclusions that in the case of a transnational crime, all the criminal activities committed in Republic of Moldova and in other states, in its integrity will constitute one unique crime, in conformity with the criminal law of Moldova and of every state where it has manifested in space. That is why we consider that Republic of Moldova, in the case of a transnational crime, can apply its criminal law only given the condition that its participating persons, in the moment of its discovery, have not borne criminal responsibility for the activities committed for its completion.
