The discovery of the humanist principle into the civil legal liability is possible only through the particularities of the civil liability, because through their course emphasizes humanism intersecting this form of liability. The legislation of the Republic of Moldova does not contain provisions defining this legal institution. For this reason, it has remained a constant concern of the doctrine of civil law. All the rules by which society is organized and functions, constitutes the legal framework of that social system. In human society is not allowed anyone to violate another person's rights field, causing some damage to someone else, by activity or by failing to. This elementary norm of conduct is not limited to legal relationships but is a very ancient human precept, known as a general rule of conduct, from the earliest times and in the most diverse communities and social arrangements. |
