Rezumat

The Republic of Moldova is increasingly confronted with the malpractice situation in the medical field, which is generated on the one hand by the lack of the technical means necessary for a correct and compliant medical act, as well as by the exodus towards Western Europe of the medical staff and auxiliary personnel in the health sector. The result of these factors is concentrated in increasingly frequent situations whereby patients resort to competent, administrative and judicial bodies for the accountability of doctors or assistants who are guilty of medical malpractice, but the legislation of the Republic of Moldova contains only some legal provisions on medical errors and these are insufficient. In such cases, patients injured by a malpractice case may undertake the following: address the medical institution with a complaint / complaint describing the problem and the damage it has suffered; to address the competent bodies to resolve the matter (even directly in court); to collect evidence before submitting appropriate complaints, for example: medical certificates, receipts certifying the medical service they have received, children from the medical card, etc., to carry out medical invitations in another institution to find out the mistake of the doctor or the assistant medical; to address to the Ethics Committee to find out the disciplinary offense of the medical worker.
