In a democratic state, the power is divided into three branches: legislative, executive, and judicial. Within the branches, a system of check and balances has to exist, which functions because of the legal control displayed by the governmental institutions, in spite of the declared independence of state power. The separation of power is based on the establishment of state power which has to be limited, without claiming on individual and public liberties. This is why the state power, has to be divided, the branches must check each other in order to create balanced and limited governance.
