This article determines the nature and the limits of the physical violence applied in the process of kidnapping. Actually, it deals with some situations from the judicial practice of the Republic of Moldova, immediately linked to the concrete cases of kidnapping committed with a clear-cut volume of violence. So, it has to be mentioned that the legislator didn’t expressly introduced the legal provision on violence in the legal norm of kidnapping. At the same time, there is no possibility to exclude that the perpetrator could apply such violence in order to facilitate commission of the crime or to submit the resistance of the victim in the moment of its kidnapping. In the limits of this scientific research there were put into discussion the concrete content of the violence manifested. Some theoretical aspects concerning aspects mentioned-above were amplified with case law. By means of such model of scientific research we tried to do our best to promote the correct interpretation and further proper application of the norm which is provided in the article 164 from the Criminal Code of the Republic of Moldova, with reference to the cases of kidnapping where a violent component is met.
