An offense can produce, in addition to socially dangerous consequences, a material or moral damage harmful to an individual or legal entity, where the offense is a source of certain civil obligations. The legal means by which the victim who has been caused a material damage requires to repair this damage is deemed a civil action. The civil action in a criminal proceeding has its source in the commitment of the offence. Thus, since by the same offense there have been violated both the rules of criminal law and the rules of the civil law, there are legal grounds that the act would involve both criminal liability and civil liability. |
