Today, the study of the essence and role of legal custom is a very urgent problem in a number of branch legal disciplines. Taking into account the historical features of the development of a number of countries that are part of the Romano-Germanic legal family, the significance and role of custom is quite large. All sources of law that are applied in the state are official documents - an external form of expression of the law-making activities of the state, mandatory for execution. The sources of law include normative legal act, judicial precedent, normative contract, general principles of law, legal custom, as well as legal doctrines. Case law is widespread in the Anglo-Saxon legal system; the Romano-Germanic legal system is characterized by the use of legal acts as the main sources of law, which has become the main difference between the Romano-Germanic legal systems. |
