This article is dedicated to the principle of the formality of the criminal process, which consists in the obligation of the criminal investigation body and the prosecutor to start the criminal investigation and immediately to carry out the procedural actions necessary to establish the criminal act and the person who committed this deed. The referenced article analyzes domestic legislation and practice regarding the application and compliance of that principle in relation to international legislation and practice. The research identifies the emerging problem and the solutions to eliminate the divergences. At the same time, the analysis of the respective subject shows the importance of the formality of the criminal process through the lens of respecting the rights and interests of the procedural subjects and the international and European guarantees granted to the parties of the criminal process. |
