Rezumat

The international community has adopted a broad set of regulations diversifying principled issues concerning the ensurance of children‘s rights, the prevention of juvenile delinquency,, the organisation of justice and the treatment conditions regarding those under the age of majority. The targeted norms have resulted in behaviour policies addressed to juvenile offenders, including and regulating various prophylactic measures: social reintegration; ensuring respect for the child‘s rights in a criminal trial; dejudicialization of the criminal trial regarding minors; the balanced application of alternative measures to custodial ones; the application of preventive custodial measures only as an exceptional measure and for as short a period of time as possible, etc. However, the special status of the child and the need to ensure the guarantees of his security in all activity fields is fully realized by the civilized society. In such conditions, of special importance are the issues related to the adequacy of the criminal and procedural-criminal policy in cases with minors, its concordance, correlation with the realities of the living circumstances. Moreover, in these conditions, the procedural-criminal law of the Republic of Moldova, is subjected to serious modernization, representing by itself a durable foundation, which ensures the proper conduct of the criminal prosecution regarding the juvenile delinquents.
