Rezumat

Naturally, the application of the criminal procedure law, as well as of any other law, cannot take place outside the social context, a context in which, in turn, a substantial weight is given to the technical-scientific progress. At the same time, in addition to the opportunities offered to the judiciary, the findings of science are quite skillfully used by criminals as well. In the competition between these factors, the judicial bodies are often disadvantaged by being obliged to act according to the legal provisions. Obviously, the legislator often does not face this competence and then, or until then, finding solutions that on the one hand would allow the capitalization of technical-scientific progress in the criminal process and on the other hand would allow the realization of this capitalization within the limits of the legal framework, it is attributed to science. These challenges can certainly be attributed to the administration of computer data in criminal proceedings and the application of criminal procedural law in space, being a problem the solutions for which they are to be identified by researchers in the field.
