The initation of the prosecution is indisputable the most important part of the criminal procedure reflecting the „motive” to initiate a procedure that has quite extensive consequences and a wide variety of solution to sanction those persons who are responsable for the comission of crimes for which the criminal low provides liability and as a result criminal punishment. The initation of the criminal prosecution represents that procedure without which there would be no permission for the resolution of de „facto” disputes and there would be no fair justice if this stage of the procedure was not invoked in the low. We are aware of the fact that initation of the prosecution, criminal low is one of the fundamental aspects for criminal investigation officers and prosecutors. Today s society is going through those legislative changes that a contemporary generation needs to deal with difficult situation that do not suffer delay, because of the timely resolution of disputes and the competence is depends on the legal authorities guaranteeing and respecting fundamental human right. This scourge which is the „start of the criminal prosecution” if it is an effective and quick one, represents the key that opens the process towards the just resolution, of the cases that usually do not suffer postponement. The Republic of Moldova is a state of low and respect for the right to a fair and fair trial is the main goal to have a fulfilled and confident society in tomorrow. Initiating criminal prosecution is the first step towards the discovery of the truth and the correct sanctioning of the responsable persons, and it is also the procedure that requires special attencion because national safety and security against illegal actions depends on it.
