For offenses with prompt execution, attempt is impossible because the first act of execution occurs simultaneously with the moment of consumption of the offense. For continuous offenses, the initial and final moments coincide; the interruption of the criminal activity due to causes independent of the will of the perpetrator refers to the moment of exhaustion of the offense, surpassing the moment of consumption of the offense. This means that attempt is excluded in the case of continuous offenses. The concept of offense with anticipated consumption is harmful and confusing. Attempt is not excluded in the case of offenses with normative alternative modalities of the prejudicial act. |
