The provisions of the Criminal Code of the Republic of Moldova that criminalize the crime of sexual harassment have been challenged in the Constitutional Court. In this study, the reasoning of the Constitutional Court of the Republic of Moldova in relation to the crime of sexual harassment is analyzed. According to the Constitutional Court, the provisions on sexual harassment can be interpreted by the court, and their meaning can be determined by reference to the common meaning of the words that compose them. Therefore, the Constitution does not constitute an impediment to the correct interpretation and application of the rule establishing criminal liability for sexual harassment. |
