The article thoroughly tackles the problems of establishing the signs of the objective side of the offences stipulated in art. 213 and 216 of the Criminal Code of Republic of Moldova. If we refer to the category of offences committed in the field of products and service consumption, it should be mentioned that the offences stipulated in art. 213 of the Criminal Code of Republic of Moldova are material offences, but the ones stipulated in art. 216, with some exceptions, are formal offences. As a component sign of the objective side, the prejudicial deed manifests itself under the form of action or inaction. Almost all the offences committed in the field of products and service consumption are realized in an action way. Only the offence stipulated in art. 213 may be committed both on action and inaction way.
