Rezumat

The state is obliged to guarantee the rights and freedoms of man and citizen, not invoking, in this respect, the hypothetical presumption of good faith and conscientiousness of the representatives of the law enforcement bodies. The requirement also applies to situations of legislative regulation of admissible restrictions on certain rights and freedoms. These guarantees are of particular importance in the field of special investigative activity, which is non-public and non-procedural. However, considering that this activity, insofar as it infringes on the rights and freedoms of the person, is ancillary, subordinated in relation to the tasks of preventing and combating crime and investigating criminal cases, the procedural guarantees of protection of the person should not be, in this case, weaker and less important than in criminal trial. One of the basic tasks of the criminal trial is the inadmissibility of prosecuting innocent people for committing crimes, which imposes strict requirements on the quality of the information obtained, used in justifying and formulating certain conclusions in criminal cases. However, all these are meant to ensure an appropriate protection of the rights and freedoms of the person in the criminal trial and in the investigative activity as a preliminary stage.
