Rezumat

Nowadays, sports order is increasingly required by certain rules, including the autonomy principle, the referees’ decision-making during the competition to the competent justice bodies. Dissemination of sports law culture in the vast community of physical education field has become a necessity in the knowledge society. The sporting phenomenon by respecting the principle of common law autonomy generates a special attention in particular by training and exercising its functions, in order to promote social cohesion in connection with respect for the fundamental rights of citizens, including health and education. Moreover, sport is an absolutely central phenomenon in contemporary society, but sports law being consolidated over the years by the experience of different sports federations (especially football one) is currently a subject dominated by autonomy and own disciplinary rules, even the clearly scientific ones. The absolute complexity and continuous improvement of a legal, law framework, which constantly facing the sports field, imposes legislators and practitioners in sports jurisprudence, to develop a specific competence, whilst without ignoring the transnational implications which sports law requires for its natural vocation. Also, the regulation and management tasks of sports organizations, including their power to impose mandatory regulations for affiliations and its members, are eloquent aspects of autonomy recognized by national legal systems and special laws. National sport is a peculiarity of acting in a certain manner in accordance with the rules of state regulation, in accordance with those of an international sports system and according to different degrees of autonomy or addiction. The sports organization is established and can develop as part of state and most international conditions (eg the European Union and the International Olympic Committee), which can create a certain degree of subordination and compliances, as well as certain restrictions of autonomy principle. In this article we aim to address certain situations and cases for respecting the principle of autonomy in sports organization, as well as certain limits.
