Rezumat | ||||||
Background. The introduction of artificial intelligence (AI) systems in medicine is one of the most important modern trends in global healthcare. AI is used to diagnose diseases, develop individual treatment protocols, monitor the patient’s condition, and complete medical records by voice, etc. Objective of the study. To highlight the basis, the ethical and medico-legal risks of the medical application of AI in the Republic of Moldova. Material and Methods. Analysis of regulations, legal acts, scientific publications, and practice of using AI in medicine (radiology, surgery, etc.). Assessing the risks associated with the moral principles underlying the decisions made by AI, as well as unethical and misbehavior of AI in relation to people. Results. The development and implementation of AI is associated with the possibility of ambiguous consequences (violation of confidentiality, possible discrimination, social stratification), with the risk of illegal actions caused by an error in the creation of AI, modification of AI as a result of unauthorized access to its system, the possibility of a criminal decision initially incorporated into the AI system. In UE countries, meanwhile, the issue of granting AI „electronic” status is being studied. In the CIS countries, whose criminal law is based on an anthropocentric approach, only individuals are responsible. Conclusion. The application of AI for the diagnosis of diseases, the development of personalized treatment, and the monitoring of the patient requires an ethical and legal regulation that minimizes the risks of its use. Special attention should be paid to the subject of the professional ethics of AI system developers. |
