This article is a scientific approach on teaching and research methods applicable to the General Theory of State and Law in universities and especially at Moldova State University. The article’s idea starts with the necessity of studying law in connection with the state. Thus, there is a review of a great scientist’s arguments submitted along the history for the existence and study of the General Theory of State and Law.
The General Theory of Law must be studied in connection with the General Theory of State, which led to their common approach, called the General Theory of State and Law. This idea was accepted by other theorists of law and teaching practice showing that you cannot make a proper image of law, without a theory of state, the general theory of law, it is the science of essentiality founding concepts of extreme generality such as, for example, the social conscience, the superstructure, which, ultimately, play a role in formulating the concepts and guidelines in the field of judiciary. The formation of the General Theory of State and Law like an independent discipline and teaching science – separate from philosophy, theology and ethics – belongs to the modern era. We can certainly say that the state is not the only factor that creates the law and ensure its realization. The research of the law without state is less effective than the formation of a general theory of these phenomena socially unique, politically and legally, giving a greater effect taken together. |
