The value of the animals, which represent the material object of the offense of illegal hunting, is established in accordance with annexes 3, 4, 41 and 6 to Law no. 439/1995. The progressive increase in the amount of payments, established in the annexes to Law no. 439/1995, as well as the increase of the amount of the conventional unit, on the basis of which the damages caused by an offense are calculated, managed to adjust to some extent the severity of the damages, produced as a result of illegal hunting, with the interest of society to react adequately and proportionately to the threats to wildlife biodiversity. In art. 233 of the Criminal Code of the Republic of Moldova, the transition from the criterion of ˮconventional units” to the criterion of ˮaverage monthly wages for the economy, established by the Government decision in force at the time of the act” could be made only after the operation of the corresponding changes in the annexes to Law no. 439/1995, which should be based on an ecological expertise. In art. 233 of the Criminal Code of the Republic of Moldova, the value threshold of 200 conven-tional units allows the delimitation of an offense from a contravention. For a more appropriate differentiation of liability for illegal hunting, it would be appropriate to complete art. 233 of the Criminal Code of the Republic of Moldova with a provision in which liability would be provided for illegal hunting in large scale proportions, not for illegal hunting in especially large proportions.
