Whereas environmental cases were virtually unheard of a generation ago, courts and administrative tribunals are today increasingly hearing environmental cases. Whether courts, administrative appeals, or other possible access to justice mechanisms are considered, three aspects of access to justice need to be examined. The first is a threshold issue – under what circumstances does a person have standing to invoke substantive and procedural guarantees? The second is the question of which specific procedures and remedies should be available once the threshold is crossed. The third is the extent of judicial control through the procedures available, also referred to as the standard of review.
