Rezumat

The author analyzes the consumption market as a social value protected by the penal law. The doctrinaire and the legislative definitions of “consumption market” are presented and analyzed. The author formulates a new definition and explains it. The analysis of the discussed notion brings out that the designated phenomenon is a social value that is a junction of the economic and social activity and it needs to be protected by the penal law. The capitalization of the products and services and, respectively, of the economic-financial potential takes place on the consumption market. The acknowledgment of the consumption market as a social value implies its recognition as a constitution of the law order, susceptible of penal law protection. The consumption market, being recognized as a social value, claims the respect of the consumer and its equality and equity in relations with the producer. In these conditions, the consumption market hints at the person, individual, on the one hand, and inclusively the juridical security, on the other hand, hints at the group, community and implicitly the public good.
