Rezumat

This article examines the case-law fields of administrative and constitutional justice, controversial issues in the specialized literature that become actual in Republic of Moldova. Even not so evident, there are some divergences of competences of these justices. The first divergence, the solution of which has been proposed in this study, is the competence of the administrative justice to examine the legality of the Government decision and the competence of the constitutional justice to examine the constitutionality of the same act. In the opinion of the author, these competences overlap one another. He suggests the constitutional justice to examine the Government decisions only in case of competence conflicts between the Government and the Parliament. The problem of competence conflicts’ examination will be considered in another study of the author.
