The subject status of the international law of the individual constitutes one of the main dilemmas of the science of the public international law at the beginning of the XXI century. The recognition of the subject capacity of the public international law and implied of international law of the human rights for the individual there follows to cause a series of important modifications of the whole classic principles, where it forms the object of study of this article.

Statutul de subiect de drept internaţional al persoanei fizice constituie una dintre principalele dileme ale ştiinţei dreptului internaţional public la începutul secolului XXI. Recunoaşterea capacităţii de subiect al dreptului internaţional public şi implicit de drept internaţional al drepturilor omului pentru persoana fizică urmează să provoace un şir de modificări radicale a tuturor principiilor clasic, fapt ce formează obiectul de studiu al prezentului articol.
