Constitutional liability represents a problem of juridical liability, that has been less structured in juridical doctrine. A democratic society and a state that has as priority the goal of becoming a state of law, has to assure the legality in all aspects. Besides this aspect, legality does not mean only to respect the law, it also concerns breaking the legal norms. Practice shows that the law is broken (enfriged) by the state it`self, by the people of law, i.e. employees of public services. That is why legislation has to be prepared, always, to face such situations. In such on orden of ideas we`ll bring examples of stipulations of Constitution of Republic of Moldova, that show a lot of responsibilities for the state.
