In this article, we will analyze the defense of the defendant absent in the trial, renouncing him at the lawyer and granting an ex officio defense. The essence of an effective defense will be analyzed. In addition, the international regulation on the rights of the defense will be presented, with the presentation of national case law and the European Court of Justice in relation to the finding of interference in the defendant's rights absent from trial in connection with the lawyer's involvement.
