One of the most controversial issues of criminal law theory is the correspondence of the institution of criminal liability release, which indirectly implies recognition of a person as being guilty of committing the offense before it was condemned by the court, the constitutional principle of presumption of innocence. The text below brings a new argument in support of the hypothesis that the prosecutor and the right of the prosecution to free the person from criminal liability and to recognize it as guilty of committing the offense against the principle stated.
