This theoretical paper deals with the sometimes unclear concept of social representations that appeared in 1961 and was meant to explain many of the social phenomena using one single physical, unifying concept. The concept is studied in terms of its relationship with "collective representations", "common knowledge" and "scientific knowledge", "ontological realism". While the concept does not have a single comprehensive definition, it strives to identify all elements for such a definition, thus filling a gap in the literature on the subject. In general, the paper presents various ways in which images of reality coexist or rather the way different kinds of reality are formed. This article aims to explore the concept of social representation of mediation in Moldova. The paper presents the results of research conducted in 2014 on two relatively homogeneous groups of subjects with legal background (legal practitioners) and laymen in terms of a new way of settling legal disputes which is mediation. The theory of social representations was used as conceptual basis, a theory that has been established and developed in the frame of the French school of social psychology. As a scientific hypothesis for the ongoing research we took the idea that legal practitioners are better familiar with the institute of mediation in comparison with laymen, thus addressing it far more often, being well aware of its advantages, while the different representations of the same concept within the studied groups are quite significant and thus constitute a hinderance in the wider applicability of this legal toolkit. The results were statistically analyzed and presented in the article. The null hypothesis was confirmed, therefore there is a difference of social representation of this concept at the system level. Thus, to achieve the goal of the research we used a toolkit largely applied to such research, that is associated with the induction method, free-association method and structured questionnaire. The method has proven itself very effective, and the results have enabled an image of this concept within the local population. Data processing was done by multidimensional analysis, still taking into account the sociohistorical background, but also the innovation of this institute within the domestic legal system. The research results revealed the main features of the mediation concept, its place in the subsystems of law. The materials obtained can be used to promote and develop this new institute for our legal system. |
