Rezumat | ||||||
The compatibility of national law with the law of the European Court of Huma Rights is of particular interest to the doctrine of international law. Creating a united Europe poses a delicate problem -compatibility of national values and those of the European Union.
According to constitutional provisions, international treaties on the protection of human rights ratified by Moldova are part of domestic law and to the extent that the latter presents more favorable provisions, shall take precedence over any other provision of law, removing and applying the principle of lex lex posterior derogat priori. This statement, although not expressly formulated appears in the Constitution of the Republic of Moldova, it appears as a logical consequence of the purpose for which enacted international human rights treaties, to ensure their protection, and not restrict them. |
