This scientific article is dedicated to clarification of the disputable aspects which appear in the process of legal appraisal of the imprudent manslaughter (art.149 Criminal code RM) exposed in the cases of the Precedent law of the Republic of
Moldova. In the realm of this research there have been define the legal nature of the criminal misdeed provided in the p.(1)
art.149 CC RM; thee have been proposed relevant answers to the disputable problems which have been appeared in the
professional activity of the criminal prosecution and judicial instances; there have been elaborated a special mechanism of
interpretation of the imprudent manslaughter and other associated criminal offences. On the base of several cases selected from the judicial practice the author has formulated relevant and useful conclusions in order to be implemented in the penal doctrine. |
