Errors in the Current Design of the Profession of Judicial Expert The article is analytic, in which the present state of affairs with regard to the place and role of judicial expert in the process of justice, issued in the national legislation of the Republic of Moldova. In the paper the causes of diffuse interpretations of the profession of legal experts and provided evidence of misunderstanding of the role of the expert in criminal and civil judicial process are described. Also the author brings examples from practice analysis of judicial expertise from other countries, explaining the meaning of profession by light perception expert as a researcher, investigating traces and material means of evidence to resolve questions related to the field of special knowledge, submitted civil or criminal cases management in order to achieve a successful judicial process. Stages are played briefly becoming a legal expert by scientific demonstration of the essence of this process, the impact erroneous conception of the concept of judicial expert and equating them with other justice related legal expertise on development in the country. On the final proposed real measures to eliminate obstacles created by this erroneous concept of the profession of legal experts, by separating processes "qualification of judicial expert" and "becoming an expert witness." |
