The juridical construction of the pre-contract, regarded as an act that produces certain rights and obligations, was partially revived by the content of the national Civil Code of 2003. The contractual practice established before this code developed particular pre-contractual agreements, especially concerning the sale of real estates. Thus, on the basis of this research we tried to explain the nature of pre-contractual acts retaining some relevant facts of their evolution history and their present normative content.
