In the present article it is revealed that unlike the offenses referred to at par.(1) art.165 PC RM. and par.(1) art.210 PC Rom from 2009, the offense specified at art.225-4-1 PC Fr does not involve the joint of main action with the adjacent action. In other words, the offense referred to at art.225-4-1 PC Fr is not a complex offense. It is also argued that unlike the naming way of the adjacent action modalities within the offence of trafficking of human beings, incriminated at art.601 PC It, the naming way of the correspondent norms stipulated in the Penal Code of the Republic of Moldova from 18.04.2002 and in the Penal Code of Romania from 17.07.2009 leaves no room for unfavorable interpretation of the Penal law. |
