In the present study it is revealed that following the legislator’s abandon of the quantifiable way of establishing the significance character of the damage, caused by offenses perpetration (including the offenses committed by circumvention), and resulted in the significant narrowing of the relevant regulations application. It is also shown that the practical application of the aggravated “by causing considerable damages” is accomplished by disregarding the principle of subjective incrimination, principle of powers separation and the principle of democracy (equality). In order to eliminate the shortcomings outlined above, there is recommended to the Moldovan legislature to return to the original interpretation of the term “considerable damages”, that is related to the amount exceeding 250 conventional units. Before this legislative change, any of the application case concerning the aggravating circumstance “the offense committed by causing considerable damages” can be considered a violation of the provisions of art.7 and 14 of the European Convention on Human Rights and Fundamental Freedoms. |
