In this article, there is analyzed the content of the objective side of the offense specified at art.2411 PC RM, namely of the prejudicial act consisting of an action (by practicing financial activities) that is accompanied by an inaction (accomplished by omission of registration and approval obtaining as provided by law). It is argued that the offence of illegal practicing of financial activity is a formal offence. It is considered completed with the moment of practicing of financial activity without registration and authorization as provided by law. The appropriateness of removing par.(2) from art.2411 PC RM. The presence of par.(2) in art.2411 PC RM is classified as technical-legislative error is signaled.
