This study exploits throughout some rigorous examination the object and the objective part of the off ence of abduction of the mean of transport, prevented at art.1921 PC RM. Especially, is pointed about the legislator’s decision to review his conception regarding the fundamental social quality comprised by the off ence of abduction of the mean of transport. Is argued about that, according to the effectual Penal Law, the special judicial object of the off ence prevented at art.1921 PC RM, has a simple complexion and not multiple, fi gured by the social relations considering the mean of transport possession. As well, is emphasized that the notion of “mean of transport”, used in the art.1921 PC RM disposal, has the same meaning as the notion of “mean of transport” stipulated at art.264, 2641, 265 and 266 PC RM. Is explained why, literally to the act of evasion, the act of abduction of the mean of transport must have a legal disposition. Finally, there are analyzed the most controversial aspects concerning the use up moment of the off ence of abduction of the mean of transport, as well as the attempt of this criminal act.
