The theory of separation of powers is the common democratic conception in which different state powers fulfill their duties thanks to their cooperation. According to this principle, all state power branches are independent but at the same time act as a common state power mechanism. Exercising the principle of separation of powers, the state bodies use their functions not by oneself but interacting with each other. The judicial power is considered to be a variety of the state authority together with the legislative and executive branches of powers. Constitutional ratification of the judicial power in the system of separation of powers helps to the mutual control and equal duties of all state bodies. The social role of the judicial power, on conditions that it is independent, is the protection of human rights and freedom of citizens, their legal interests with the help of disputes and arguments authorization. The judicial power, which realizes its potential of independence and impartiality, according to its principle of separation of powers, provides a balance and interaction fulfilling its functions by all the branches of the government. |
