Rezumat

Recognition is an evidentiary procedure provided for in the Criminal Procedure Code of the Republic of Moldova. It is also a variant, a specific form of forensic identification. The purpose of this evidentiary procedure is to give some subjects of criminal proceedings the opportunity to recognise, from among the persons or objects presented, those whom they have previously known or observed. If we are to be guided by the combination of „subject and object”, this evidentiary procedure has many forms and varieties. What they all have in common, however, is that the identifying subject must memorise the image of the person or object presented for recognition, identify it, establish that it is a complete coincidence, or give a negative response to the identification. The presentation for recognition has its own specificity, which distinguishes it from other evidentiary procedures: it cannot be replaced by hearing, conf rontation, etc. A correct perception and understanding of the nature and content of an identification is necessary, first of all, for the correct performance of this evidentiary procedure and, last but not least, for the assessment of the authenticity, credibility and probative value of the results obtained in the process of investigation of criminal cases.
