Any subjective right makes it possible to commit known actions, known acts of use or disposal. The exercise of the right consists in the commission of those actions that make up this right. The Roman concept of law - ius - corresponds to both the meaning of a legal norm, a legal order, and the idea of a right belonging to an individual by virtue of the prescriptions of common law. The exercise of the right consists in the commission by a person of actions that serve to satisfy his/her positive interests (uti, frui) protected by law, and in countering the violation of these rights (imperare, vetare). Any person has the right to exercise his right, or completely refuse to use it. Moreover, the use of their rights is allowed, but within certain limits - boundaries. So, according to Guy, in the first case: Nullus videtur dolo facere, gui iure suo utitur. No one is considered malicious if he exercises his right. And yet: We must not misuse our right; on this basis, the squandering of their property is prohibited. Male enim nostro iure uti non debemus; gua ratione et prodigies interdicitur bonorum suorum administratio. |
