| Rezumat | ||||||
In this study, the following forms of unity of crime are analyzed: complex crime, deviated crime, in an unique way. Thus, the notions of each form of unity of crime were defined, along with their characteristic features, their location in the criminal code, with the assignment of eloquent examples with their involvement, taken from judicial practice. The alternative normative methods, provided in paragraph (1) article 243 of the Criminal Code of the Republic of Moldova, and established the impact on the qualification of the unity or plurality of crimes. Last but not least, arguments were established for and against the doctrinal theories regarding the forms of the criminal unit. |
