Rezumat

In this paper, the Draft Law for the amendment of some normative acts (amendment of the Criminal Code and the Contraventional Code), published on July 28, 2022, is analyzed. In this Draft Law, it is proposed to amend and complete art. 2606 of the Criminal Code of the Republic of Moldova as follows: in paragraph (1) the text „damages in large proportions” is replaced with the phrase „considerable damages”; in paragraph (2) letter b) the text „damages in particularly large proportions” is replaced by „damages in large proportions”; it is supplemented with paragraph (3) which provides for the aggravation of the deed in the event of a particularly large amount of damage. In this respect, arguments are presented in support of the positive aspects of the examined project. At the same time, certain provisions of the project that cannot be accepted are criticized. In order to improve the legal framework, reasoning is presented focused on the principles of drafting normative acts on the changes that should be made in art. 260/6 of the Criminal Code of the Republic of Moldova.
