In the present study the institution of author's excess is analyzed. A distinction between the author's excess and criminal participation is made. The forms of author's excess are identified. The algorithm for qualifying the conduct of the participants in the crime in the hypothesis of quantitative and qualitative author excess is identified. Some legislative deficiencies that mark the text of art. 48 of the Criminal Code of the Republic of Moldova are highlighted. Finally, a new wording of the article in question is proposed. |
