rough this article, the author intends to analyze the concept of constitutionalization of the right to freedom of creation as well as the role of the state in this process. e constitutionalization process is a complex one and involves three systems of activity: legislation, law enforcement and constitutional justice, which leads to an in depth analysis of this phenomenon. e main purpose of this study is to identify the need to confer the right to freedom of creation of a constitutional nature and how the state ensures this. By incorporating the right to freedom of creation into the system of constitutional norms, it gives it a superior legal force over the legal norms enshrined in normative acts. e constitutionalization of the right to freedom of creation is a complex process of transforming the right with the participation of the state and citizens. e purpose of the transformation process is to ensure the supremacy of the constitution, ideally to raise awareness of the importance of constitutionally enshrined social relations and the need to comply with the rules governing them, including the right to freedom of creation.
