Rezumat

The prison universe is a very complicated, harsh, unpredictable and in the same time a very sensitive one in terms of granting rights and applying the sanctions that people who are serving a custodial sentence have. The penitentiary is the place where no one wants to go; however, sometimes by mistake or carelessness, people that had an exemplary conduct in society and have not had contact with criminal law all their lives also end up behind bars. Knowing the rights offered by the legal framework to those sentenced to imprisonment becomes essential in this situation and information regarding the obligations and prohibitions in this dark place can bring you faster among the free persons.The rights of those behind bars, in the last 20-30 years, have been constantly in the center of society’s attention by approaching the subject by both politicians and the media. In most cases, in order to attract the electorate or the audience, the rights of those who have committed crimes have been changed, interpreted and developed so that sometimes they have come to exceed those of members of society who are in hospitals, educational institutions or other state institutions. The sanctions that can be applied to persons deprived of their liberty have also been widely debated and there has often been no attempt to reduce or eliminate some of them through the intervention of non-governmental bodies with state institutions or with persons holding important positions. The notion of prison has appeared since ancient times and is a building, a place where a person executes a custodial sentence, imprisonment, dungeon, penitentiary, arrest, prison.[1] I believe that the rights to be offered as well as the sanctions that can be applied to those in detention should not be confused in any way with the rights of a free person because sentencing to a custodial sentence implies the restriction of certain rights for a certain period of time. It is normal and indicated that the environment in which the detainee finds himself is of lower quality than the environment of the one who is in the society, who works, who brings a plus or who at least does not affect the good functioning of the community. Otherwise, at least for those with poor fi nancial strength, accommodation inside a holding establishment would become an alternative to consider.
